Political States are legitimate, if they adequately protect the human rights of their constituents and respect the rights of all others. State is under a duty to turn over some substantial portion of its sovereign powers to international institutions. A legitimate State is a democratic State. The legitimacy is collectively held by the people, who constitute a State. The moral right of political self-determination of a State is held by it on behalf of the group of persons who constitute the State. |
